Amendments of Articles 140 and 141 of the Labour Code

On 1 December, 2011, the Law amending and supplementing Articles 140 and 141 of the Labour Code under which Article 140 and Article 141 were amended and supplemented has entered into force.

New changes are related to the regulations on the severance payment after termination of the employment contract with employee, who has been made redundant in accordance with Articles 129 and 136.1.6 from state or municipal institution financed from the state or municipal budget, the State Social Insurance Fund or from other public funds, state or municipal enterprise, public institution owned by the state or municipality, or the Bank of Lithuania.

In accordance with these new regulations, the severance payment:

  • shall be started to pay after 1 month of termination of the employment contract and
  • shall be paid in equal monthly instalments.

The payment shall be terminated if:

  • a person begins to serve as a public servant or
  • is employed by the state or municipal institution financed from the state or municipal budget, the State Social Insurance Fund or from other public funds, state or municipal enterprise, public institution owned by the state or municipality, or the Bank of Lithuania.
